These Terms and Conditions ("Terms") govern your access to and use of https://aiherf.com and the hosted AIHerf products and services provided by AIHerf, Inc (the "Service").

By using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old, able to form a binding contract, and comply with applicable law.

Accounts

You agree to provide accurate information, keep it current, protect your credentials, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account and organization.

We may suspend or terminate accounts that violate these Terms, create security risk, cause service abuse, or expose AIHerf or others to legal or operational risk.

Subscriptions and Billing

Some features require a paid plan. Prices, limits, included features, trial terms, and billing intervals are shown at checkout or in the Service.

By purchasing a plan, you authorize AIHerf and its payment processors to charge the payment method you provide for applicable fees, taxes, renewals, upgrades, and usage-based charges. Unless stated otherwise, subscriptions renew automatically until canceled.

Cancellation stops future renewal charges but does not automatically refund amounts already paid, except where required by law or expressly stated by AIHerf.

One-Time Usage Credits

One-time usage credits are optional, prepaid usage amounts. They are not a subscription and do not renew automatically. A workspace may purchase one-time usage credits only while it has an active paid plan, and only an organization owner or administrator may authorize the purchase.

One-time usage credits belong to the workspace for which they were purchased, not to an individual account. They cannot be transferred between workspaces or people, resold, redeemed for cash, or used to avoid plan limits or access restrictions.

Each purchase has its own 365-day validity period beginning on the purchase date. Canceling, downgrading, suspending, or ending a paid plan does not pause, restart, or extend that period. After a paid plan ends, unexpired one-time usage credits remain available, but only for features and permissions included in the workspace's then-current plan. One-time usage credits do not unlock paid features, seats, team permissions, or any other plan entitlement.

Subscription credits are used before one-time usage credits. If a workspace has multiple one-time credit purchases, the credits with the earliest expiration date are used first.

Use of the Service

AIHerf grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business or personal purposes.

You agree not to:

Violate applicable laws or third-party rights.
Submit unlawful, harmful, misleading, infringing, abusive, or malicious content.
Access accounts, systems, data, or networks without authorization.
Interfere with, overload, or degrade the Service.
Reverse engineer, scrape, crawl, harvest, or extract data except as expressly permitted by AIHerf.
Use the Service to build a competing product or service.
Circumvent plan limits, billing controls, security controls, or access restrictions.
Upload malware or automated abuse traffic.

Customer Content and Results

You retain ownership of information, prompts, project data, domains, keywords, URLs, reports, files, and other materials you submit or generate through the Service ("Customer Content"). You grant AIHerf a limited license to process Customer Content as needed to provide, secure, maintain, support, and improve the Service.

Outputs may rely on third-party data, automated analysis, or AI systems and may be incomplete, delayed, or inaccurate. You are responsible for reviewing outputs before relying on them.

Third-Party Services and Data

The Service may depend on third-party infrastructure, analytics, payment, email, data, AI, or other providers. AIHerf is not responsible for third-party services, data, availability, pricing, policies, or outputs.

Intellectual Property

AIHerf and its licensors own all rights, title, and interest in the Service, software, design, branding, trademarks, documentation, and related technology, except for Customer Content.

You may not copy, modify, distribute, sell, lease, sublicense, create derivative works from, or provide access to the Service or its software except as expressly permitted by these Terms or separate written permission from AIHerf.

Privacy

Our collection and use of personal information is described in our Privacy Policy.

Availability and Changes

We may change, suspend, discontinue, or limit any part of the Service at any time. We aim to provide a reliable Service but do not guarantee uninterrupted, error-free, secure, or continuous availability.

Termination

You may stop using the Service at any time. We may suspend or terminate access for violations, nonpayment, risk, or harmful use. Provisions concerning ownership, payment, disclaimers, liability, indemnification, and disputes survive termination.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIHERF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

AIHERF DOES NOT WARRANT SPECIFIC SEARCH RANKINGS, TRAFFIC, REVENUE, OR FREEDOM FROM ERRORS, INTERRUPTIONS, SECURITY INCIDENTS, OR DATA LOSS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIHERF, INC AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COSTS OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIHERF'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100. Some jurisdictions do not allow certain limitations.

Indemnification

You agree to defend, indemnify, and hold harmless AIHerf, Inc and its officers, employees, agents, affiliates, suppliers, and licensors from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Service, Customer Content, violation of these Terms, or violation of law or third-party rights.

Changes to These Terms

We may update these Terms from time to time and will update the date above. Your continued use after updated Terms become effective means you accept them.
